Good360 places a high priority on protecting your privacy and we provide you with this Privacy Policy to inform you about how and when we process personal information that we collect through our website www.good360.org (“Website”), our products and services, and our social media profiles (collectively, “Services”). By using the Good360 Website, you consent to the data practices described in this document.

This Privacy Policy explains what types of information are collected by the Website and how this information is used. This Privacy Policy does not apply to any third-party websites, service or applications, even if they are accessible through the Services.

1.    Collection of your Personal Information

Personal Information” is information that can reasonably be used to directly or indirectly identify a person. We collect your Personal Information from different sources, including directly from you, through automated means, from social networking platforms, business partners, and other sources as described below. This Privacy Policy applies to all Personal Information, whether collected online or offline.

a.    User-Provided Information

In order to better provide you with the Services offered on the Website, Good360 may collect personally identifiable information, such as your:

  • Company/organization name;
  • First and last name;
  • Mailing address;
  • Shipping address;
  • Email address;
  • Phone number; and
  • Photograph(s) or videos for purposes of content creation (we do not use such data for identifying individuals).

We use a third-party payment provider to process donations and we do not collect credit card information when a donation is made to our organization.

We do not collect any Personal Information from you unless you voluntarily provide it to us.  However, you may be required to provide certain Personal Information to us when you elect to use certain features or Services available on the Website.  These may include: (a) registering for an account on the Website; (b) entering a contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) signing up for email newsletters and other communications; (g) completing surveys; (f) posting a comment or otherwise contributing to a social forum on the web site. 

We will use your information for, but not limited to, communicating with you in relation to Services you have requested from us. 

b.   Automatically Collected Information

As is the case with many websites, Information about your computer or mobile device hardware and software may be automatically collected by Good360.  This information can include: your IP address, browser types, domain names, access times and referring website addresses, the type of device on which the Services are used or downloaded, the operating system, name and version of the device used to access the Website, device manufacturer, device ID, and geolocation data. 

This information is used for the operation of the Services, to maintain quality of the Services, and to provide general statistics regarding use of the Website. In order to improve our Services, we may receive a notification when you open an email from Good360 or click on a link therein.

Among other things, this information enables us to generate analytics reports on the usage of the Website. To opt-out of your Website usage being included in our Google Analytics reports, you may follow the instructions at https://tools.google.com/dlpage/gaoptout.

c.    Use of Cookies

The Website may use “cookies” to help you personalize your online experience.  A cookie is a text file that is placed on your hard disk by a web server.  Cookies cannot be used to run programs or deliver viruses to your computer.  Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time.  The purpose of a cookie is to tell the web server that you have returned to a specific page.  For example, if you register with the Website or Services, a cookie helps Good360 to recall your specific information on subsequent visits.  This simplifies the process of recording your Personal Information, such as billing addresses, shipping addresses and so on.  When you return to the Website, the information you previously provided can be retrieved, so you can easily use the features of the Website.

You have the ability to accept or decline cookies.  Most web browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies if you prefer.  If you choose to decline cookies, you may not be able to fully experience the interactive features of the Website.

d.   Information Provided by Third Parties

We also acquire Personal Information about you from third parties, such as business partners, non-profit organizations, social media channels, entities to which you volunteer your information or you direct to share data with us, and others.  This information includes publicly available information, contact information, your profile information, and your preferences.

e.    Social Networking

We maintain a presence on several social networking and blogging platforms which are operated by third parties, such as Facebook, Twitter, Instagram, LinkedIn, and YouTube. Through these platforms and features, we receive some Personal Information about you, and this Privacy Policy applies to that information as well. However, this Privacy Policy does not apply to the processing activities that third-party social networking platforms and blogging platforms perform with your information.  Those platforms have their own privacy policies, which explain how they will use, protect and share your information, and we encourage you to read them.

2.    Use of your Personal Information

Good360 collects and uses your Personal Information to perform the following business functions:

  • Enabling users to use the Website and its features;
  • Providing our Services and processing and fulfilling your transactions;
  • Administering the Website and your account with us;
  • Responding to your requests, questions, and concerns;
  • Market research;
  • Developing new features and offerings on the Website;
  • Consistent with any communications preferences you have set on the Website, sending you marketing and other communications, including announcements, promotional offers, alerts, confirmations, surveys and/or general communications about products, services, and events, of ours and of others, that we think might interest you. You may opt out of receiving such notices from us by following the instructions in the Opt In and Opt Out section below;
  • Protecting our rights and property;
  • Recovering debt and preventing fraud;
  • Customizing the Website to your interests and history with us;
  • Tailoring ads displayed to you on the Website and elsewhere to your interests and history with us;
  • In connection with organizational changes or dissolution, including for example a merger, acquisition, reorganization, consolidation, bankruptcy, liquidation, sale of assets or wind down of operations; and
  • Other purposes disclosed when Personal Information is submitted to us or when we receive your consent.

To perform the above functions, we may match information collected from you through different means or at different times, including both Personal Information and Automatically Collected Information, and use such information along with information obtained from other sources (including third parties) such as demographic information and updated contact information.  We or our service providers may also use your information to assess the level of interest in, and use of, the Website, our e-mails and our other messaging campaigns both on an individual basis and in the aggregate.

3.    Sharing Information with Third Parties

Good360 does not sell, rent or lease its customer or donor information to third parties, and we do not share, trade or exchange that information in any way, except as provided herein. However, information you voluntarily post to public areas on the Website will be available to other Website users.

As described in the Use of your Personal Information section, Good360 may, from time to time, contact you about a particular offering or member benefits that may be of interest to you, including benefits from our business partners, such as discount or coupon codes.  In those cases, your Personal Information is not transferred to the third-party.

We may share your Personal Information to the extent necessary to provide the Website and fulfill our mission. This includes, but is not limited to, updating, securing, and troubleshooting, as well as providing support. 

  • Information Shared with Co-sponsors

Good360 may share your information with our co-sponsor(s) if we obtain your information in connection with a contest, sweepstakes, offering, or other promotional activity that is jointly offered by us and any third parties, unless you instruct us not to by following the instructions in the Opt In and Opt Out section below.

We may engage third-party services providers to work with us to administer and support our business. These third-party services providers generally have access to your Personal Information only for the purpose of performing services on our behalf. Examples include hosting our web servers, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service.

Good360 may also share data with other trusted partners to help perform statistical analysis, send you email or postal mail, or arrange for deliveries. For example, we may store your data on external data storage sites or servers provided by third-party hosting vendors with whom we have contracted. All such third parties are prohibited from using your Personal Information except to provide these services to Good360, and they are required to maintain the confidentiality of your information.

We utilize Google Analytics for our web analytics and you can opt out of your Website usage data being included in our Google Analytics reports by visiting https://tools.google.com/dlpage/gaoptout.

Good360 may disclose your Personal Information, without additional notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Good360 or the Website; (b) protect and defend the rights or property of Good360; and/or (c) act under exigent circumstances to protect the personal safety of users of Good360 or the public.

In addition, we may disclose your Personal Information if legally required to do so, pursuant to a request from a governmental entity, or if we believe in good faith – after considering your privacy interests and other factors – that such action is necessary to:

  • Conform to legal requirements or comply with legal processes (including subpoenas);
  • Enforce or apply our terms of use and other agreements, including for billing and collections purposes;
  • Protect our property rights, rights and safety or property, rights and safety of a third-party, our affiliated companies, or the public in general; or
  • Stop any activity that we consider illegal, unethical, or legally actionable.

We may disclose such Personal Information to third parties if you consent to such disclosure.

  • Your Choices About Your Personal Information

We respect the choices that you make with respect to your privacy and therefore provide you with the following options with respect to your Personal Information. You may request:

  • Access to your Personal Information to know what information we have collected about you;
  • That we correct your Personal Information if such data is out of date or incorrect; or
  • That we delete any Personal Information that you have provided to us (please note that if you choose to exercise your right to delete, we cannot delete your Personal Information without also deleting your user account).

In the event you decide to exercise these rights, we will do our best to honor your request upon a verified request.

  1. Opt In and Opt Out

You may have the right to opt in to or opt out of certain of our uses and disclosures of your Personal Information.  For example, when you are asked to provide Personal Information on our Website, you may have the opportunity to elect to, or not to, receive messages from us by e-mail. If you would like to stop receiving marketing or promotional communications via email from Good360, you may opt out of such communications by clicking on the unsubscribe link in any email and updating the “manage preferences” form. You can also opt-out of our promotional emails by sending us your name, address, e-mail and phone number to: support@good360.org. Please understand that it may take us a few days to process any opt out request and that even if you opt out of receiving promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us.

  • Security of your Personal Information

Good360 takes reasonable measures to secure your Personal Information from unauthorized access, use or disclosure. Unfortunately, due to the inherent nature of the Internet as an open global communications vehicle, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. We cannot guarantee that any information, during transmission through the Internet or while stored on our system or otherwise in our care, will be absolutely safe from intrusion by others, such as hackers.

As a result, while we strive to protect your information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and us through the Website cannot be guaranteed. While no website or electronic data can ever be completely secure, we are always working to maintain up-to-date and appropriate security mechanisms.

We use a variety of security measures to protect your Personal Information and our data. We maintain procedural, electronic, and physical safeguards to help prevent unauthorized access to and improper use of personally identifiable information.

We protect the security of credit card transactions using measures such as encryption, access controls, network firewalls, and physical security. These measures make it extremely difficult for anyone to intercept any credit card information you send to us. When we work with other companies to process credit card transactions, those companies also use encryption and other appropriate security measures.

We will have no liability for disclosure of your information due to errors or unauthorized acts of third parties during or after transmission.

If you create an account on our Website, you are responsible for maintaining the strict confidentiality of your account password, and you shall be responsible for any activity that occurs using your account credentials, whether or not you authorized such activity.  Please notify us of any unauthorized use of your password or account or any other breach of security.

If at any time during or after our relationship we believe that the security of your Personal Information in our care may have been compromised, we may notify you of that development.  If a notification is appropriate, we will endeavor to notify you as promptly as possible under the circumstances and in accordance with applicable laws. 

  • Data Retention

Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

  • Children

Good360 does not knowingly collect Personal Information from children under the age of 13, and the Website is not intended for users who are under 13 years old.  If we learn that we have collected Personal Information of a child under 13 without verification of parental consent, we will take steps to delete such information from our files as soon as possible.

  • Your Rights Under California’s Shine the Light Act

We do not disclose Personal Information to third parties for their direct marketing purposes.

  • Changes to this Privacy Policy

Good360 reserves the right to change this Privacy Policy from time to time.  We will notify you about significant changes in the way we treat Personal Information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our Website, and/or by updating any privacy information on this page.  For some changes to our Privacy Policy, we may ask for your consent in accordance with applicable laws.

  1. Supplemental Notice for Residents of Colorado and Oregon

This section of the Privacy Policy supplements the information contained above and applies solely to Website visitors and others who reside in the States of Colorado and Oregon (“consumers” or “you”). We adopt this notice in accordance with the Colorado Privacy Act and the Oregon Consumer Privacy Act (collectively the “Applicable Laws,” each an “Applicable Law”). Any terms defined in your state’s Applicable Law have the same meaning when used in this notice. 

In particular, this section provides additional details regarding the Personal Information that we collect or process about you. For purposes of this section, “Personal Information” has the meaning given to it in the Applicable Laws.

Under Colorado and Oregon law, users who are residents of these states have specific rights regarding their Personal Information. These rights are subject to certain exceptions described below. When required, we will respond to most requests within 45 days unless it is reasonably necessary to extend the response time. Subject to certain limitations, you have the following rights:

  • How to Exercise Your Rights

To exercise the rights described above, please submit a verifiable consumer request to us by emailing us at: support@good360.org.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to a total of 90 days), we will inform you of the reason and extension period in writing.

In order to protect your privacy and the security of your information, we may verify consumer requests by requesting identification documents and other documentation necessary to confirm your identity for certain requests. Any additional information you provide will be used only to verify your identity and not for any other purpose.

Please note that making a verifiable consumer request does not require you to create an account with us. 

  • Authorized Agents

You may use an authorized agent to submit a request to opt out. When we verify your agent’s request, we may verify both your and your agent’s identity and request a signed document from you that authorizes your agent to make the request on your behalf. To protect your Personal Information, we reserve the right to deny a request from an agent that does not submit proof that they have been authorized by you to act on their behalf.
